A 4-year-old girl died Wednesday in the city of Sidoarjo, East Java after being run over by a car driven by her own father.

On Wednesday morning, the father, identified by his initials KF, dropped off his daughter, MS, at school. KF reportedly didn’t walk MS inside the school himself and was unaware that she had walked in front of the car before he accidentally ran her over.

MS, who went under the front right tire, passed away after being taken to a nearby hospital.

Though no charges have been filed in the case, the police strongly suspect that the reason KF didn’t see MS in front of his car was because he was preoccupied with his phone as he was driving. As such, it is possible that KF will be charged with negligent homicide for his own daughter’s death.

“That’s clearly negligence, he can be charged with Article 359,” East Java Police Spokesperson Frans Barung Mangera told Okezone yesterday.

Frans was referring to Article 359 of the KUHP (Penal Code), which states that negligent homicide is punishable by up to five years in prison.

In light of the shocking incident, the Indonesian Traffic Police said it would raise public awareness about the dangers of using mobile phone while driving and call upon its officers to get tough on anyone whose eyes are on their screens rather than on the road.
