‘Epileptic’ driver in fatal TransJakarta crash posthumously charged

A TransJakarta bus driver identified as J, who was one of the two people killed in last week’s collision between two buses, has been posthumously charged with negligence after police ruled that he was solely responsible for the crash.

On Oct. 25, J was driving his bus and rear-ended another bus on the TransJakarta-exclusive busway lane on Jalan MT Haryono in Cawang, East Jakarta. 

J, along with a passenger on his bus, were killed, while 37 other passengers sustained injuries.

Following their investigation, police concluded that the crash was caused by human error on J’s part, as he failed to brake while the bus was going 55 km/h on the lane just before the collision.

“Based on the investigation, the driver had a history of epilepsy,” Jakarta Metro Police spokesman Yusri Yunus said during a press conference today.

TransJakarta has not said whether or not it was aware of this aspect of J’s medical history.

The charge against J is likely a mere formality, considering that under Indonesia’s Criminal Code (KUHP), criminal charges are void if the defendant dies.
