College student killed and then charged with negligent driving in crash with ex-police general

A college student was posthumously charged with negligent driving after his fatal crash with a former police general last year.

The incident occurred on Oct. 6, 2022 in Jagakarsa, South Jakarta. Hasya Atallah Syaputra, an 18-year-old student at Universitas Indonesia (UI), was driving his motorbike when he collided with a Mitsubishi Pajero SUV driven by a retired police general identified by his initials ESBW.

Hasya died in the crash.

Police said investigation into the crash stalled as they tried to mediate ESBW and Hasya’s family in order to reach a settlement. The investigation was recently relaunched after the two parties failed to find common ground.

Today, the Jakarta Metro Police announced that Hasya was determined to be at fault for the crash and was therefore charged with negligent driving.

“This was due to [Hasya’s] negligence in driving a motorcycle, so he caused his own death. [ESBW] was not negligent,” Jakarta Metro Police Traffic Department Director Latif Usman said at a press conference.

According to the police, Hasya and ESBW were driving in their respective lanes before the victim immediately swerved right and encroached the cop’s lane in order to avoid a water puddle. ESBW’s car rammed into Hasya, killing the teenager.

Police noted that rain was falling at the time of the incident, but said that it was all the more reason for Hasya to drive with even more caution.

Investigation into the case has been terminated as the only suspect is deceased.
