Woman held in police remand without charge for 42 days

Mother of three Rosemary Ginam is entering into her 43rd day behind bars, despite no having any actual charges pressed against her.

Rosemary’s lawyers, husband and family maintain that she is innocent, and merely being used as a scapegoat by her former employers who are being accused of fraud relating to non-existent travel packages they sold to over 30 would-be holidaymakers.

Dulcet Travel and Tours first came on police radar in July of this year, after angry consumers accused them of selling discount travel tours that never came to fruition. While Rosemary’s role in the alleged scam is unclear, she was an employee of Dulcet, and after a litany of reports were lodged against the company, she was unceremoniously arrested in front of her Kajang home July 17. Her children were present when their mother was cuffed, and she has been in holding ever since.

Breaking the story, local outlet The Star have detailed that Rosemary’s husband, Hasan Jambai, has now filed his own report, in conjunction with the Human Rights Commission of Malaysia (Suhakam).

Legally, authorities are only allowed to keep suspects linked to cheating cases for seven days in remand. However, Rosemary’s lawyers explain that police have been refreshing her remand order every few days, and moving her to different stations around the country.

The Star reveals that since her mid-July arrest, she has been taken to police stations in Kuala Lumpur, Perak, Penang, Melaka, Terengganu and Negeri Sembilan.

She is currently being held in a Putrajaya lock-up under a new remand order until tomorrow, August 29.

Not mincing words, her lawyer Rajesh Nagarajan says:

“There is a term for this. It is called a roadshow or tukar gari, and it is a clear violation of her fundamental human rights by the police to hold her without trial.”
