Nitcharee Pen-eakchanasakm, the Thai teenager who lost both her legs when she fell onto the tracks at Ang Mo Kio MRT Station in April 2011, has lost in the lawsuit against the SMRT and Land Transport Authority (LTA).
Nitcharee, who’d been 14 years old at the time and taking English lessons in Singapore, was run over by an incoming train when she fell, but did not appear to have been pushed.
She had sued the two authorites for negligence.
Judicial Commissioner Vinodh Coomaraswamy however, ruled on Jan. 2 that SMRT and LTA are not liable in negligence to Nitcharee’s injuries.
According to Channel NewsAsia, he had stated the law of negligence awards compensation based on a defendant’s culpability, and not simply the harm suffered by the plaintiff.
Nitcharee has a month to appeal.
