Supreme Court blocks five-day liquor ban

The Supreme Court has issued a temporary restraining order on a five-day liquor ban that the Commission on Elections was supposed to implement starting Thursday.

The TRO was prompted by a petition from Food and Beverage Inc and International Wines and Spirits Association Inc. They said the Comelec overreached its jurisdiction by extending the liquor ban beyond the period in the Omnibus Election Code. Under the law, the liquor ban is only effective on the day before election day and on election day itself.

According to a Manila Bulletin report, the petitioners said the Comelec issued the five-day liquor ban arbitrarily and did not hold hearings before doing so. The petitioners said this violated their right to due process. They also said the five-day ban would cause them irreparable damage.
