SC halts curfew implementation in QC, Navotas and Manila

There wil be no curfew for minors in QC, Navotas or Manila… at least for now. 

The Supreme Court (SC) on Tuesday temporarily stopped the implementation of curfew ordinances for minors in the three cities in response to a petition filed by a youth group earlier this month. 

According to Inquirer, the court “issued a TRO effective immediately and until further orders enjoining the three local government units from implementing and enforcing the ‘curfew ordinances’.”

The local government units have 10 days upon receipt of the resolution to comment on the petition. 

It may be recalled that the youth group Samahan ng Progresibong Kabataan (SPARK) said that the “Curfew Ordinances” deprived minors of the right to liberty and right to travel without due process. The parents were also deprived of their natural right to rear their children. 

The Manila ordinanace in particular, was slammed for being contrary to Republic Act No. 9344 or the Juvenile Justice and Welfare Act as it punishes violators. 

“Curfew is allowed only if no penalty shall be imposed on children caught violating the curfew,” Inquirer adds.

The curfews in these cities begin at 10pm and last up to 4am in Manila, Navotas and up to 5am in Quezon City.
