“In a bid to protect airline passengers from stress of delayed and cancelled flights, the Makabayan bloc is pushing for the immediate passage of Magna Carta of Airline Passengers’ Rights,” reports Jester P. Manalastas on Journal Online.
The report noted: “The House Bill 5361 was filed by Bayan Muna Reps. Neri Colmenares and Carlos Isagani Zarate; Gabriela Reps. Luz Ilagan and Emmie de Jesus; Kabataan Rep. Antonio Tinio; Anakpawis Rep. Fernando Hicap and Kabataan Rep. Terry Ridon.”
An InterAksyon.com report written by Lira Dalangin-Fernandez enumerates some of the provisions that the bill seeks for affected passengers (words in enumeration taken directly from InterAksyon.com report):
1. Rebook the flight, the departure time of such being the most convenient for the air passenger concerned and without additional costs.
2. Cancel the contract of air carriage and get the full refund of the air fare within 24 hours from the time this choice is made; provided, that if the refund is not given within the aforesaid period, the air carrier shall refund the air fare double its value; provided, further, that when the refund was not made within three (3) days from the time the choice is made, the air carrier shall make a refund triple the value of the air fare, and so on until the full refund is finally made.
3. Endorsement to another air carrier without additional expenses within 24 hours from the scheduled overbooked flight.
4. For an hour’s delay, the air carrier would be required to provide passengers free food and beverage.
5. If the delay is due to the air carrier’s negligence, it should pay PHP10,000 or actual damages, whichever is higher, to the passenger.
