The Court of Appeals says Bonifacio is actually part of Makati

Residents and office workers at Fort Bonifacio experienced an existential crisis on Monday as the Court of Appeals ruled the fort is part of Makati and not Taguig City.

Well, okay, that didn’t happen, but the CA did rule that Fort Bonifacio is under the jurisdiction of Makati.

According to a report on Manila Bulletin, the appeals court said the fort area as well as barangays Cembo, South Cembo, East Rembo, West Rembo, Comembo, Pembo and Pitogo as well as the Inner Fort Barangays (Barangay Post Proper Northside and Barangay Post Proper Southside) are part of Makati.

The court affirmed constitutional two Presidential proclamations that put the area under the jurisdiction of Makati. It also noted the delay it took for Taguig to claim the area as part of its jurisdiction considering the proclamations were issued in 1986 and 1990. Taguig only disputed Makati’s ownership of Fort Bonifacio in 1993.

The CA said in the report that “considerable delay in asserting one’s right before a court of justice is strongly persuasive of the lack of merit of his claim, since it is human nature for a person to enforce his right when same is threatened or invaded.”

It has ordered Taguig City to cease exercising jurisdiction over the disputed area.
