Comelec 1st Division disqualifies Poe from 2016 polls

The Commission on Elections (Comelec) 1st Division has canceled the certificate of candidacy of Senator Grace Poe for president in the May 2016 polls.

Voting 2-1, the three-member 1st Division, which is chaired by Commissioner Christian Robert Lim, canceled the COC for material misrepresentation when she claimed in her COC that she “is a natural-born Filipino citizen and has resided in the Philippines for at least 10 years.”

Comelec Commissioners Luie Guia and Rowena Guanzon voted to cancel Poe’s COC, while Lim dissented.

“The Comelec ruled in favor of petitions filed by UE College of Law Dean Amado Valdez, former Senator Kit Tatad, and De La Salle University professor Antonio Contreras,” report Paterno Esmaquel II and Jee Y. Geronimo on Rappler.

Earlier, the Comelec’s 2nd division earlier also disqualified Poe based on the petition filed by Atty. Estrella Elamparo.

Poe’s lawyer, Atty. George Garcia, told dzMM that their camp “will file a motion for reconsideration before the Comelec en banc on December 15 or 16.”

Garcia went on to say that that they “will wait for the final decision of the Comelec en banc before proceeding to the final arbiter, the Supreme Court.”
