Makati prosecutor dismisses theft complaint filed by Kris Aquino against former business associate

In the ongoing war between actress Kris Aquino and her company’s former managing director Nicko Falcis, the latter has won — for now.

The Makati City Prosecutor’s Office today dismissed the qualified theft case that Kris filed against Falcis, citing lack of probable cause.

In a resolution dated Feb. 18 but released to the media today, the prosecutor’s office said: “After careful examination of the records of the case, this Office is inclined to dismiss the complaints as there is no sufficient evidence to engender a well-founded belief that Falcis committed the crimes charged.”

In November, Kris accused Falcis of supposedly using the credit card of her company Kris Cojuangco Aquino Productions (KCAP) for his personal expenses, amounting to PHP1.27 million (US$19,721).

The theft allegedly occurred in July last year.  Kris also said that Falcis gave her a check worth PHP437,597.67 (US$8,404) as partial payment for the amount that was charged in the card.

Aside from Makati, she also filed her complaint in other cities where the theft allegedly occurred: Quezon City, Mandaluyong, Pasig, San Juan, Taguig, and Manila.

The Makati Prosecutor’s Office said however that since the card was in Falcis’ name, “he can use the card for his purchases.”

The office also said that there was no proof presented by Kris that Falcis used the card to defraud her and that Falcis is liable only to BDO, the bank which issued his credit card.

In a statement, Falcis’ lawyer, Regi Ponferrada said: “We agree with the resolution of the Office of the City Prosecutor of Makati City and we want to reiterate what we have been saying for the past months, that is, Nicko Falcis is innocent of the charges against him and that he did not steal or commit any crime whatsoever.”

He added: “We hope that the other prosecutors where the other similar cases are pending will also agree with our position.”

Falcis and Kris have been engaged in a word war since the case became public. Falcis alleged that at one point, Kris threatened his life if he returned to the Philippines from Bangkok.

He had filed a complaint of grave threats against Kris.

The daughter of the late President Corazon Aquino with national hero Ninoy Aquino, and the younger sister of former President Noynoy Aquino, Kris is an influential television show host and actress in the Philippines. She recently appeared in a cameo in the film Crazy Rich Asians.

At present, she’s very active on social media and is still a sought-after endorser of various brands.
