The Bangsar Ria daycare centre for children with disablilities in Section 12 PJ, hit last month with a legal motion by its neighbours to shut it down, will find out today if it can continue to operate in its current premises.
The Shah Alam High Court is scheduled to rule today on the application filed by the two neighbours to revoke the planning permission granted to the Bangsar Ria centre by the Petaling Jaya City Council (MBPJ) allowing the premises to be used as a daycare centre for children with disabilities.
The applicants argued that it was unlawful and contrary to provisions in the National Land Code for the MBPJ to have given permission to the daycare centre to set up shop where it did, and are also seeking a court order restraining the owner of the premises from using the house as anything other than as a dwelling.
In their statement of judicial review, the supplicants said they have suffered nuisance throughout the day from 8.30am to 5pm, Monday to Friday, as a result of intolerable noise made by the disabled children and their attendants and carers.
“(The applicants have suffered) nuisance of experiencing the uncomfortable sensation of seeing the disabilities and sufferings of all the special children, the whole day, day in day out,” they added in their statement.
