The Hong Kong woman who was convicted of assaulting a senior police officer with her breast during a protest has successfully appealed her jail sentence.
Ng Lai-ying, aged 30, was unable to overturn her conviction, but won an appeal against her three-and-a-half month jail term at the Court of First Instance yesterday.
In a written judgment, Judge Judianna Barnes acknowledged that Ng appeared to have assaulted the officer in an attempt to help her boyfriend, Kwong Chun-lung.
However, Barnes stressed that Ng may still face jail time if she didn’t show remorse for her actions, SCMP reports. She will be sentenced on Sept. 26, pending a report on her suitability for community service.
The “breast assault” took place during a protest against parallel traders in Yuen Long last March. Ng testified in court that Chief Inspector Chan Ka-po had placed his hand on the upper part of her left breast, after which she shouted “police indecent assault”.
Ng said she was pushed to the ground and injured, and she was seen with blood on her face prior to her arrest. Police officers serving as witnesses in court said Ng had fallen down of her own accord and rubbed the blood on her face.
