Charges against an RTHK production assistant accused of punching a passerby during last year’s Occupy protests have been dropped.

The Kwun Tong Court heard on Friday that the case of common assault against defendant Cheung Yuk-kin could no longer result in a conviction.

It was alleged that Cheung, 34, hit a passerby at the junction of Nathan Road and Shan Tung Street, Mong Kok, during a political protest on Oct. 3.

Although it is known that the alleged victim had not been located, the prosecution declined to say whether they were abandoning the case because of a lack of evidence.

Cheung was cleared of all charges by the magistrate.

According to the SCMP, an earlier hearing, the judge questioned the prosecution’s decision to raise the case despite the absence of a known victim.
