Man convicted of raping, making child pornography of 9-year-old daughter

A 61-year-old man has been convicted on ten charges for raping and producing child pornography of his daughter – who was between the ages of five and eight at the time – from 2011 to 2014.

The man, who could not be identified for legal reasons, was convicted of six counts of rape and four counts of producing child pornography yesterday in High Court. Apple Daily reports that the jury unanimously ruled that the 61-year-old was guilty after less than five hours of closed-door deliberations.

The defendant is reported to be a Hong Kong native, with no history of mental illness or drug addiction. He had sole custody of his daughter from 2011-2014, as her mother had difficulty securing a visa after reportedly being imprisoned in mainland China for illegally selling scrap metal.

Earlier this month, his now nine-year-old daughter testified that she had been raped by her father “over a hundred times”, and had been denied food “perhaps because she refused to let him molest her”. 

She recalled that her father had made lewd photographs of her twice, but was told by him that the pictures were deleted. Prosecutor Flora Cheng said photographs of the girl’s genitals and penetrative acts were found on her father’s phone and camera.

However, the defendant reportedly told police that he didn’t know where the photos came from, and claimed the devices had been borrowed by others.

Judge Maggie Poon emphasised that the case was “particularly serious”, and said “all penalties will be considered”.

The maximum penalty for rape in Hong Kong is life imprisonment.

The defendant will be sentenced next month.
