A Hong Kong man who exposed his genitals to his domestic helper in 2014 has been sentenced to five weeks in prison.
Shek Kwok-ngai, aged 43, denied four indecent assault charges and one count of common assault in Kwun Tong Court yesterday, SCMP reports.
He was found guilty on one charge of attempted indecent assault for showing his genitals to his helper, but acquitted on three indecent assault charges related to masturbating near her, and one common assault charge for “breathing heavily behind her”.
In February, his domestic helper, who was identified as X, testified that Shek had masturbated near her and exposed his genitals to her on four occasions between Feb. 26 and March 3, 2014, as well as breathing heavily behind her on Feb. 28.
After the 43-year-old reportedly fondled his penis near her three times, X filmed the fourth incident with a secret camera, which apparently recorded Shek exposing his genital area for six seconds while staring at X in the kitchen.
Shek alleged that he hadn’t meant for X to see him. Magistrate Vennie Chiu denied his claims, saying he was “well aware” X was inside, as the kitchen was small.
Chiu sentenced Shek to five weeks’ imprisonment, but acquitted him of four charges, reportedly saying that the victim, while honest, was not specific enough in her account of events.
X failed to sufficiently distinguish between “fondling”, “touching”, and “scratching”, the latter two of which could not be indecent, Chiu said.
