An elderly man who was accused of raping his daughter’s mentally ill friend three years ago has been found not guilty, a court ruled Wednesday.

The defence maintained that the woman initiated sexual intercourse with the 64-year-old man, surnamed Yeung, first, HK01 reported.

The case concerns a January 2018 incident, during which the woman, identified as X, visited Yeung’s home at Wah Kwai Estate in Pok Fu Lam.

According to Apple Daily, Yeung turned on the television and offered X—who is 30 years his junior—a soft drink. Then, he asked her to get into bed with him and removed her pants. Yeung forced her to have unprotected sex with him even as she resisted and said she was in pain, reports state.

Yeung stopped when he received a call from his daughter asking when they were ready to have lunch. The two left the house and met Yeung’s daughter at a restaurant.

X later told her mother about the incident, who alerted the police.

During the trial, the prosecution said that X is mentally handicapped with a below-average IQ of 65 and is also movement impaired in her left arm and leg. She attended a special education school as a child, and requires help from her mother completing daily tasks such as showering and washing her hair.

In an earlier testimony, X said that she initiated intercourse with Yeung and told her friend that she wanted to “have a baby” with her father. But X later walked back her statement, explaining that she tripped on her words and did not mean what she said.
